Sentencing DUI or DUI Per Se First Offense

If you are convicted of a DUI or DUI Per Se as a first offense, you will be subject to the following:


A jail sentence between 5 days and 365 days. All the jail may be suspended on completion of an alcohol/drug evaluation and treatment. ***If the BAC was .2 or higher, then there is a 10 day jail sentence which must be imposed (it may be served on home detention).

A fine between $600 and $1000, all of which may be suspended.

Community Service Between 48 and 96 hours.

Probation up to two (2) years.

Restitution

MADD victim impact class.
