DUI Sentencing In Colorado - part 1 First Offenses

The Colorado Revised Statutes, 42-4-1307, provides for the penalties for "traffic offenses involving alcohol and drugs." Unlike most criminal penalties, this statutory provision leads very little in terms of discretion to the sentencing judge.


First Offenses may be sentenced between 5 days and one year to the county jail - ALL OF WHICH MAY BE SUSPENDED ON THE CONDITION THE OFFENDER COMPLETES A LEVEL II ALCOHOL EDUCATION PROGRAM. Therefore, in my experience it is rare to have a first offender serve actual jail time except where there is an accident or the offender is under the age of 21.
